1. Definitions and Interpretations
"Blueskyphotos L.L.C." refers to Blueskyphotos L.L.C.
"Customer" refers to the individual or entity purchasing the aerial photography services.
"Services" refers to the aerial photography, videography, and related services provided by Blueskyphotos L.L.C.
“FAA” refers to the federal aviation administration.
2. Agreement to Terms
By booking, purchasing, or using our services, you agree to comply with and be bound by these Terms and Conditions. This is affirmed when you sign your invoice.
If you do not agree to these Terms, you must refrain from using our services.
3. Service Description
Blueskyphotos L.L.C. provides aerial photography and videography services using unmanned aerial vehicles (UAVs) or drones.
The scope of work, deliverables, and duration will be specified in the service agreement or project proposal.
4. Customer Responsibilities
The Customer is responsible for obtaining any necessary permissions or approvals “other than from the FAA”, for the use of drones at specific locations (e.g., private properties, restricted areas) this includes but is not limited to: Media release forms, filming permits from the government and or property owner, model releases, music releases, proof of insurance on the filming property. The Customer is required to provide necessary access and assistance during the shoot as requested by Blueskyphotos L.L.C.
5. Drone Operation and Safety
Blueskyphotos L.L.C. will operate drones in compliance with all relevant aviation laws and regulations, including the Federal Aviation Administration (FAA) or equivalent governing body regulations.
Blueskyphotos L.L.C. reserves the right to cancel or reschedule the flight if weather conditions, safety concerns, or legal restrictions prevent safe operation of drones.
6. Scheduling and Cancellations
Blueskyphotos L.L.C. will work with the Customer to schedule the aerial shoot. However, Blueskyphotos L.L.C. is not responsible for any delays due to weather, technical issues, or other external factors.
The Customer must provide at least 3 days’ notice for cancellations or rescheduling. Cancellations between 3 days and 24 hours of the film date at start of day can be rescheduled for a fee or 10% of the total service fee or canceled for a 20% fee of the total service fee. Cancellations within 24 hours of the scheduled date may incur a cancellation fee of 40% of the total service fee or to reschedule available for 40% of the total service fee.
7. Intellectual Property and Ownership
Blueskyphotos L.L.C. retains all intellectual property rights to the images, videos, and other content created until the final product has been purchased by the customer.
8. Delivery of Final Content
Blueskyphotos L.L.C. will deliver the final content within the agreed-upon timeline, subject to weather delays or other unforeseen issues.
9. Liability and Insurance
Blueskyphotos L.L.C. is insured for drone operations but does not assume responsibility for any damages to the Customer’s property, injuries, or third-party claims arising from the aerial photography session.
The Customer agrees to hold harmless and indemnify Blueskyphotos L.L.C. from any claims, damages, or losses resulting from the use of the Services.
10. Payment and Fees
A deposit of 40% is due at least 1 week prior to the start of the day of work, and full payment is due upon delivery of the final product, unless otherwise agreed.
Blueskyphotos L.L.C. reserves the right to charge additional fees for any extra services not initially agreed upon (e.g., extended flight time, additional locations, or specific customer requests.)
11. Force Majeure
Blueskyphotos L.L.C. will not be held liable for any failure or delay in performance of its obligations due to events beyond its control, including but not limited to natural disasters, acts of government, or technical failures.
12. Confidentiality
Both Blueskyphotos L.L.C. and the Customer agree to keep all project details and any proprietary information confidential unless otherwise required by law.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the state of Florida and the FAA.
Any disputes that cannot be resolved amicably shall be resolved through [arbitration/mediation] or in the courts of the state Florida.
14. Amendments
Blueskyphotos L.L.C. reserves the right to modify these Terms and Conditions at any time. Customers will be notified of any changes, and continued use of services will constitute acceptance of the updated terms.

16. Right to Refuse Service and Refund Policy
Blueskyphotos L.L.C. reserves the right to refuse service to any individual or organization for any reason, including but not limited to safety concerns, violation of policies, or inappropriate behavior. In cases where services are refused or canceled by Blueskyphotos L.L.C. after payment has been made, refunds will be issued in the form of service credit unless otherwise agreed upon in writing. Cash refunds will only be provided at the sole discretion of Blueskyphotos L.L.C. under exceptional circumstances.
